With over twenty years of experience in the field, I have successfully navigated the intricacies of family law appraisals. I have spent the last fifteen years developing, writing, and defending appraisal reports for use in litigation. I have trained under and now regularly partner with some of Arizona’s best practitioners in litigation. My reports have been developed with the hard-won experience from hundreds of prior cases, each building on the next. I can serve one of two primary roles when working in Family Law:

·       As an independent Appraiser – When working as an Appraiser I work as an independent, impartial, third party and can provide an Opinion of Market Value in an Appraisal Report, an Appraisal Review, and provide testimony as an Expert Witness. An appraiser can only advocate for their opinion, not the interests of the client. The appraiser must remain neutral.

·       As a Consultant – When working as a Consultant I may work as an advocate which can include offering opinions on strategy and working behind the scenes.

·       Date of Valuation - The valuation date is crucial in divorce cases. It is often the date of separation, filing for divorce, or another specific date determined by the court. Clearly understanding and adhering to this date is essential.

·       Purpose of the Appraisal - The purpose of the appraisal in divorce cases is often to determine the Fair Market Value of marital assets, such as the family home. The appraisal may also be used for equitable distribution or to establish the buyout amount if one party keeps the property.

·       Subjectivity and Emotion - Real estate often holds emotional value for divorcing couples. Appraisers need to be sensitive to the emotional aspects and potential biases that may arise during the appraisal process.

·       Unique Property Characteristics - Some properties may have unique features or characteristics that impact their value. This could include historical significance, custom renovations, or other factors that require special consideration.

·       Complex Ownership Structures - In some cases, divorcing couples may have complex ownership structures, such as fractional or partial interests. Appraisers must be well-versed in the legal implications of these structures.

·       Understanding Legal Requirements - Appraisers need to be familiar with local divorce laws and regulations, as they can vary significantly. This includes understanding any specific reporting requirements for divorce-related appraisals.

·       Communication - Effective communication is crucial when working with divorcing couples and their legal representatives. Appraisers need to clearly convey their findings and be prepared to address questions or concerns from both parties.

·       Expert Witness Testimony - Appraisers may be required to provide expert witness testimony in mediation, arbitration, or court. Narrative Reports: - starting at $2,500

This report format is written in long form and does not include the standard appraisal forms typically associated with home loan appraisals. Narrative Reports provide in-depth analysis and extensive documentation, making them suitable for complex, high-value appraisals or cases likely to undergo close scrutiny.

Strengths:
 Delivers an in-depth analysis with comprehensive detail and documentation, suitable for complex, high-value appraisals or cases expected to undergo close scrutiny.

Considerations: Time-intensive due to the extensive level of detail.Time-intensive.
This report type 

 

Form Reports: - starting at $600
A shorter, standardized report format suited for typical appraisal needs where a full narrative isn’t necessary. Form Reports are often used in cases with well-defined parameters and limited complexity.

Strengths: A concise, structured format suited to typical uses where a full narrative isn’t necessary.

Considerations: Due to their structure and brevity, Form Reports may not be the best choice for situations requiring intense scrutiny or where disagreement is likely.

 

Restricted Appraisal Reports: - fees vary
A limited-scope report focused on specific, named intended users, often used in amicable scenarios such as dissolutions or arbitration where a streamlined approach is sufficient. Restricted Appraisal Reports omit extensive support for opinions and conclusions, making them efficient yet concise.


Strengths:
 Streamlined and efficient, ideal for amicable dissolutions and arbitration scenarios.
Considerations: Limited to specific, named intended users. This highly condensed format lacks extensive supporting rationale for conclusions and opinions.

 

The Appraisal Process
